The Pennsylvania PUC issued an Advanced Notice of Proposed Rulemaking on Thursday. The topic is the regulation of Distributed Energy Resources (“DER”) participating in the wholesale markets. The rulemaking is quite comprehensive, acknowledging the line between wholesale (FERC) and retail (PA) regulation. It will address some of the very complex issues where resolution is required for effective DER regulation, such that consumers can benefit from these very promising technologies.
